How Tennessee Law Defines Drug Trafficking

Tennessee Code Annotated section 39-17-417 prohibits knowingly manufacturing, delivering, selling, or possessing a controlled substance with the intent to manufacture, deliver, or sell it. This conduct may be charged as trafficking or distribution.

Prosecutors may pursue charges based on allegations of:

• Manufacturing a controlled substance
• Delivering or selling a controlled substance
• Possession with intent to sell or deliver
• Conspiring or attempting to commit a prohibited drug offense

Tennessee divides controlled substances into seven schedules based on factors such as accepted medical use and potential for abuse. Heroin is a Schedule I substance, while fentanyl is generally classified under Schedule II. The type and quantity of the substance, alleged conduct, and applicable statutory thresholds can determine the felony classification.

Prison, Fines, & Property Forfeiture

Many trafficking allegations are prosecuted as felonies. A Class B felony carries a possible sentence of eight to 30 years, with the applicable range affected by factors such as prior criminal history. Certain drug convictions can also carry fines of up to $100,000.

The Drug Free School Zone Act can increase punishment for qualifying offenses committed in or near designated schools, parks, and other protected areas. Whether it applies can depend on the precise location, distance, timing, presence of children, and offense date. We examine those details instead of assuming an enhancement listed in the charging documents is valid.

Civil asset forfeiture is a separate proceeding in which the government may seek cash, vehicles, real estate, or other property allegedly connected to drug activity. Its deadlines and procedures differ from those in the criminal case, so property claims require prompt attention. A forfeiture action can continue even without a criminal conviction.

How Felony Cases Move Through Lebanon Courts

The Wilson County Criminal Justice Center in Lebanon houses General Sessions Court and Criminal Court. A felony case may begin in General Sessions Court with a preliminary hearing. The hearing determines whether probable cause exists to send the charge forward, not whether the accused is guilty.
